In practice, there is already a need for expert opinions from independent professional expertise – and not only to be used as evidence in court, and not only on issues defined for experts in the field of law by procedural legislation. Business entities turn to professional experts to make a decision, either individually or jointly with a counterparty, on how to resolve a practical problem that has arisen in their business activities, referring to the expert opinion of an independent professional expertise obtained at their own request, but from a specialist whose professional knowledge they trust.
Thus, independent professional expertise must be legally regulated, and accordingly, related issues such as the concepts of «professional expert», «requirements for institutions that organise and conduct independent professional expertise», «risks in conducting independent professional expertise», and others must also be regulated. The introduction of independent professional expertise will facilitate accessibility in resolving practical issues, primarily those related to civil law regulation.
