| When it is necessary to confirm the grounds for applying the negotiated procedure for public procurement in accordance with Article 40 of the Law of Ukraine ‘On Public Procurement’ or the purchase of goods (works and services) without using open tenders and/or an electronic catalogue for procurement in accordance with paragraph 13 of the Specifics approved by Resolution of the Cabinet of Ministers of Ukraine No. 1178 dated 12 October 2022. According to the court’s conclusions, an expert opinion is the only valid document for conducting procurement under a non-competitive procedure (Supreme Court Resolution of 19 December 2019 in case No. 910/17438/18). |

- overhead costs of IPE LLC, costs for payment of taxes established by the legislation of Ukraine.
